I wouldn't put them under the axle unless there is a strap restricting downward movement of the axle, using the shock absorbers to stop downward movement of the axle would damage the shock absorbers. You would also want to restrict upward movement of the axle to prevent striking the pipes on the road. You would want to make the measure considering flat tires as you wouldn't want to drag the pipes on the road while stopping the vehicle with a flat tire. The noise and police issue has already been covered. If you look at glasspac mufflers you'll see they go straight through.
